Conditions for Approval of EIA Report

COMPLIANCE

1. All mitigation and control measures stated in the EIA Report titled Detailed Environmental Impact Assessment Study for the Proposed Development of Sg. Selangor Dam in Hulu Selangor, Selangor Darul Ehsan by Konsortium TSWA-Gamuda-KDEB, February 1999, Supplementary Information May 1999 and Additional Information May 1999 prepared by SMHB Sdn. Bhd. consultants have to be fully implemented.
 

PROJECT CONCEPT

2. The project involves among others the construction of a drinking-water supply dam with the concept of a regulating dam, rockfill type with a height of 110m based on crest level from riverbed, width of 800m, full supply level of 220m LSD, across Sg. Selangor at km 66.5 Federal route from Kuala Kubu Baru to Fraser's Hill involving an inundation of 600ha, for the purpose of pumping water at Rasa and Batang Berjuntai intake point, 250Mld and 800Mld respectively.  Other components in the project are the construction of a spillway, generator facility with minimum electricity generation of 1MW for use by the dam and the new water treatment plant in Rasa, coffer dam with crest level of 135m LSD, diversion tunnel with 7m diameter and 451m length, realignment of road (Federal Route 55) length of 8km and water treatment plants at Rasa and Batang Berjuntai with a capacity of 250Mld and 800Mld respectively.

3. Release of residual flow into Sg. Selangor at Batang Berjuntai should be maintained at not less than 300 mld at all times and increased based on a study on the effect on fireflies in Kampung Kuantan that has to be carried out and completed before the dam is filled.

4. The catchment for Sg. Selangor has to be gazetted and a copy of the gazettement submitted to the Head Office of the Department of Environment and Selangor Department of Environment.

5. The resettlement programme for the Orang Asli in Kampung Peretak and Kampung Gerachi has to be prepared and fully implemented according to the proposal of the Selangor State Orang Asli Resettlement Committee.

6. Logging activities and land clearing should only be carried out in the dam area, not exceeding 600ha and limited to the inundated area as specified in the EIA Report Figure 3.4.

7. The dam area, which is to be inundated, must be cleared of all plant refuse and construction waste before the dam is filled with water.

8. Design of road and relating infrastructure should follow the topography of the area.

9. Operation, management and monitoring of the dam should abide by the "Malaysian Inter-Departmental Committee on Dam Safety" guideline.

10. Quarry activity is only allowed to supply construction material for the dam project.
 

CONTROL OF EARTHWORKS AND LAND CLEARING

11. Earthworks should be carried out in stages in accordance with the phase of development.

12. Transportation vehicles plying the construction site should avoid from going through residential areas.

13. Any activities in the dam area specifically logging, clearing, stacking of trees, earthworks and others should be controlled and begin from downstream to upstream to enable wildlife to move into the nearby forest.

14. Existing cover crops need to be left as it is during clearing of the area to be inundated to assist in protecting surface soil from exposure to agents of erosion especially in steep areas.  Duration between clearing work and inundation should be shortened.

15. Land opening and cutting should only be carried out in areas to be developed.  Exposed land in areas that are not going to be inundated must be protected and planted with cover crop immediately using methods such as coconut matting and hydroseeding.

16. Excess soil should not be disposed in areas out of the project site but used as embankments at the boundary of the project site.  The embankment should be fortified and stabilized by planting cover crop.
 

WATER QUALITY CONTROL AND MONITORING

17. Sedimentation ponds, silt traps and drainage systems to channel surface run off should be prepared before earth works are carried out.  Any release from the sedimentation pond to any water channel should not contain more than 100mg/l of suspended solids.  Monitoring of suspended solids from the sedimentation ponds should begin from the day earthworks are carried out.

18. Design of erosion control such as silt traps and sedimentation ponds should get validation at design and implement stages from Professional Engineers in related field.  Copies of document for approval and validation must be submitted to the Selangor Drainage and Irrigation Department and the Selangor Department of Environment.

19. Monitoring of Sg. Selangor water quality upstream and downstream of the dam site must be conducted in the construction and operational stage of the project.  Parameters to be monitored are flow rate, Dissolved Oxygen (DO), Biochemical Oxygen Demand (BOD), Cadmium (Cd), E. Coli, Suspended Solid (SS), oil and grease, and pH.

20. Disease control measures especially from water and vector borne (such as typhoid, cholera, gastroenteritis and malaria) must be fully implemented as required by the Health Ministry of Malaysia.
 

AIR QUALITY CONTROL AND MONITORING

21. Open burning of plants and construction waste is strictly prohibited.

22. Blasting of rocks must be conducted in a controlled way (control blasting/delay blasting).  Quantity of explosives used each time during blasting must be limited to a level that does not cause problem of vibration
and airborne stones surrounding the quarry site.

23. All sources of dust and air pollution must be equipped with effective pollution control measures.  The
following equipment must be incorporated in the design of quarry equipment:

i. All drilling equipment must be equipped with dust control system.

ii. All crushers and screens must be surrounded or closed and equipped
                        with effective dust sucking system.

iii. Primary crusher, secondary crusher, tertiary crusher and all transfer
            points must be equipped with effective sprinkler system.

iv. Conveyor system must be fully covered and transfer of rocks from
            conveyor to open stock pile must be through slotted chute.

24. All open stock piles must be dampened with water to curb dust pollution.

25. Water storage facility must be prepared for the purpose of control of dust pollution.

26. Quarry operation must be stopped immediately when equipment or pollution control system breaks down and can only resume operation after the control system is repaired.

27. Monitoring of ambient air quality for suspended dust (PM10) parameter must be conducted from the beginning of construction work of the dam and quarry.

NOISE AND VIBRATION CONTROL AND MONITORING

28. Noise should be controlled not to exceed 65dBA during daytime and 55 dBA during nighttime measured at the boundary of the dam and quarry site during construction and do not cause a nuisance to surrounding residents.

29. Vibration form quarry operation must be controlled not to exceed 5 mm/s surrounding the boundary of the quarry site.
 

SOLID WASTE MANAGEMENT

30. Solid waste including construction debris must be collected and disposed in a disposal site approved by the Hulu Selangor District Council.

31. Disposal of plant waste is not allowed in the inundated area and near water channel.
 

SAFETY AND EMERGENCY CONTROL

32. Emergency Response Plan to face any accidents or emergencies must identify evacuation of neighbouring residents (in necessary situation) and prepared after consultation with the Police Department, Fire Services Department, local authority and residents near the project site.

33. Safety monitoring plan of all dams in terms of structural endurance must be prepared and submitted to the Public Works Department and Department of Environment of Selangor.
 

ENVIRONMENT MONITORING PROGRAMME

34. Monitoring programme of river water quality, air quality, noise and vibration that takes into consideration monitoring level and frequency of sampling must be submitted to the Selangor Department of Environment for approval three months before construction commences.
 

REPORT

35. During project implementation, project proponent must ensure and submit a compliance report (PPE2) that shows that all conditions for approval and prevention measures are adhered to under Section 34A(7) Environmental Quality Act 1974, Amendment 1996.

36. The following reports must be submitted to the Department of Environment of Selangor:

i. Report on monitoring and evaluation of water quality of Sg. Selangor,
            upstream and downstream of project site, must be submitted every three
            months commencing from the day earthworks begin.  A lab accredited
            under the "Malaysian Lab Accreditation Scheme" must conduct analysis
            of the parameters.

ii. Report on sampling of suspended solids from sedimentation ponds during
            earthworks and construction work must be submitted once a month from
            the commencement of earthworks.

iii. Ambient air quality monitoring and evaluation report must be submitted
            every three months from the commencement of earthworks.

iv. Noise and vibration report must be submitted every three months from the
            commencement of construction.

37. Environmental Audit Study report on the effectiveness of environmental control measures that is stated in the EIA report must be submitted to the Selangor Department of Environment once in a year commencing from the construction date.  The Department of Environment must first approve the Term of Reference for this study.  If the Director General deems that an independent audit is required to ensure level of compliance, the audit costs must be borne by the project proponent.
 

ENVIRONMENT MANAGEMENT PLAN (EMP)

38. An Environment Management Plan following the format as enclosed, must be prepared and submitted to the Head Office of the Department of Environment and Selangor Department of Environment three months before earthwork commences. The EMP must be reviewed and altered from time to time as required.
 

ADMINISTRATION

39. The project proponent, before commencement of earthworks, must appoint an environmental consultant who would be responsible for every control and mitigation measure that is implemented.

40. The officer responsible for matters concerning environmental management must be in the organizational structure.

41. Any change in property ownership or management and change of company name must be notified in writing to the Selangor Department of Environment.

42. The Selangor Department of Environment must be notified in writing the actual date of commencement of the project not later than 14 days after the project begins and actual date of the completion of the project not later than 14 days after the project is completed.

43. A copy of the conditions for approval of the EIA report together with the documents that is part of the conditions of approval and EIA report must be exhibited in a suitable location and can be seen at the project site.

44. All mitigation and prevention measures that are proposed in the EIA report including conditions in this approval letter must be made part of the contract document for the dam construction and operation, drinking water intake level and related works.

45. The dam rehabilitation plan must be prepared and submitted to the Department of Environment six months before the dam's life span ends or the project is no longer operational, whichever happens first.
